Anybody can purchase property here in Guatemala providing you have the funds and a passport. There has not been a significant case of Government expropriate of land from foreign owner(s) and this makes Guatemala a safe haven for your investment dollars. Here in Antigua and many touristic parts of Guatemala you will encounter many like minded individuals who have taken their surplus assets or life savings and purchased property and existing companies with pleasure.

When making your investment choice, like with any investment in any country, qualify your investment with a top notch lawyer. Ask around to 3 or 4 major investors here in Antigua, Guatemala who they trust for Notary’s or Attorney’s or else contact your local embassy. This is your first best step. Never share the same lawyer unless you are confident they are providing equal (here in Guatemala separations of duties are not adhered to but in remote regions it is highly recommended you do not purchase property unless you use a qualified lawyer from the city… no matter how great a deal you are being offered). Deposits for purchase actions should never be made out to the seller but held in ESCROW via a qualified Realtor or held in trust via a bank. International purchases via wire transfers are common and need strong legal representation to make all sides of the transactions to run smoothly.

This being done, the final steps are in the registration of the papers and the title of the ownership is yours. One main item, though ownership in your individual name is more then secure and easy to do, but to purchase any property or business via a Guatemalan Incorporation (aka Sociedad Anonima, aka S.A.). The shares of the Corporation (S.A.) are the control of the property and in the event of death or sales, the property management of the Estate is much easier to handle instead of via individual ownership. Further, tax issues on purchases and sales of Estates through a S.A. are more advantageous and should be considered in advance of your property purchase.
